1. Who we are
The Service is operated by FlowSight, the legal business name of the seller ("FlowSight", "we", "us", "our"). FlowSight provides an AI-powered cash flow copilot for small and medium businesses (the "Service"). By using the Service you enter into a contract with FlowSight. Contact: hello@flowsight.app.
2. Acceptance
By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. You must be of legal age to contract in your jurisdiction.
3. Your account
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and keep it updated.
4. Acceptable use
You must not:
- use the Service for any unlawful purpose, fraud, or spam;
- infringe the intellectual-property or privacy rights of others;
- upload malware, probe, scan or attempt to breach security, scrape, or reverse-engineer the Service;
- resell, sublicense or redistribute the Service without our written consent;
- use AI outputs to generate illegal content, hate speech, deepfakes intended to mislead, or content that infringes third-party rights.
5. AI features
The Service includes generative-AI features (the "AI Copilot", weekly briefings, scenario analysis). You are responsible for your prompts, for how you use outputs, for verifying accuracy, and for ensuring you have rights to any content you input. Outputs may be inaccurate or incomplete and are not a substitute for professional financial, legal, tax or investment advice. Decisions based on AI outputs are your responsibility.
We may filter or refuse outputs, remove content, and suspend or terminate accounts that repeatedly violate our acceptable-use rules. Rights-holders may submit takedown requests to hello@flowsight.app.
6. Intellectual property
We retain all rights, title and interest in the Service, its software, documentation and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You retain ownership of the transactions and content you upload, and grant us a limited license to host and process that content solely to provide the Service.
7. Payments, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation and refund mechanics, please refer to Paddle's Buyer Terms. Our Refund Policy is available at /refunds.
Subscriptions renew automatically each month until canceled. You can cancel at any time from the Billing page in the app or via Paddle's customer portal; cancellation takes effect at the end of the current billing period.
7a. Bank connections (optional)
If you choose to link a bank account, that connection is provided by Plaid Inc. as our account information aggregator. When you link, you authorise Plaid to retrieve account and transaction data from your bank on your behalf and share it with FlowSight. Access is read-only — neither FlowSight nor Plaid can move money via this connection. Your use of the bank connection feature is additionally governed by Plaid's End User Privacy Policy. You may disconnect a bank at any time from Settings, which revokes the Plaid access token and deletes all bank-imported transactions from FlowSight. In the UK and EEA, consent must be renewed every 90 days per PSD2 SCA rules; we will prompt you to re-authorise.
8. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination we will delete your account data within a reasonable period, subject to legal retention requirements. You may export your data before termination by emailing us.
9. Service level and warranties
The Service is provided "as is". We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service will not exceed the fees you paid to us in the 12 months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud, death or personal injury caused by negligence.
11. Indemnity
You will indemnify us against third-party claims arising out of your content, unlawful use of the Service, or your breach of these Terms.
12. Changes
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which FlowSight is established, without regard to conflict-of-laws principles. Disputes will be submitted to the exclusive jurisdiction of the courts of that jurisdiction.
